Agreement to Terms
These Terms of Service govern your use of services provided by NextLevel Fremont Tree Services, located at 39300 Civic Center Dr STE 350, Fremont, CA 94538. By engaging our services, you agree to be bound by these terms. If you do not agree to these terms, please do not use our services.
Services Provided
NextLevel Fremont Tree Services provides professional tree care services including but not limited to tree removal, tree trimming and pruning, stump grinding and removal, emergency tree services, land and lot clearing, tree health and maintenance, arborist consulting, and shrub and hedge trimming. All services are performed by qualified professionals in accordance with industry standards and local regulations.
Service estimates are provided in good faith based on information available at the time of inspection. Final costs may vary if site conditions differ from initial assessment or if additional work is required to safely complete the project.
Scheduling and Cancellation
Service appointments are scheduled based on availability and weather conditions. We make every effort to arrive at scheduled times but reserve the right to reschedule due to weather, equipment issues, or emergencies. We will provide reasonable notice of any schedule changes.
Clients may cancel or reschedule appointments with at least 24 hours notice without penalty. Cancellations with less than 24 hours notice may be subject to a cancellation fee to cover mobilization costs.
Payment Terms
Payment is due upon completion of services unless other arrangements have been made in writing. We accept cash, check, and major credit cards. For large projects, we may require a deposit before work begins.
Invoices not paid within 30 days of service completion will be considered past due and may be subject to late fees of 1.5% per month or the maximum allowed by law. Collection costs and attorney fees incurred to collect past-due accounts will be added to the balance owed.
Property Access and Client Responsibilities
Clients must provide clear access to work areas and ensure pets are secured during service. Clients are responsible for marking or identifying any underground utilities, irrigation systems, or other hidden features on their property that could be affected by our work.
Clients must obtain any necessary permits required by local authorities before work begins. We can assist with permit applications but ultimate responsibility for permit compliance rests with the property owner.
Liability and Insurance
NextLevel Fremont Tree Services maintains comprehensive general liability insurance and workers compensation coverage. We are not responsible for damage to underground utilities, irrigation systems, or other features not clearly marked by the client or professional locator services.
Tree work involves inherent unpredictability. While we use professional techniques and exercise reasonable care, we are not liable for damage caused by hidden defects in trees, unexpected weather events, or other circumstances beyond our control. Clients are encouraged to maintain homeowners insurance covering tree-related incidents.
Warranty and Guarantees
We guarantee our work will be performed in a professional manner consistent with industry standards. However, we cannot guarantee the survival or future health of trees as many factors affecting tree health are beyond our control. Any warranties specific to particular services will be outlined in written service agreements.
Limitation of Liability
To the maximum extent permitted by law, our total liability for any claims arising from services provided shall not exceed the amount paid for those services. We are not liable for indirect, incidental, consequential, or punitive damages.
Dispute Resolution
Any disputes arising from these terms or services provided shall be resolved through binding arbitration in Alameda County, California, in accordance with the rules of the American Arbitration Association. Both parties waive the right to jury trial.
Changes to Terms
We reserve the right to modify these Terms of Service at any time. Updated terms will be posted on our website with a revised date. Continued use of our services after changes are posted constitutes acceptance of modified terms.
